The new construction products regulation

Regulation (EU) 2024/3110 was published in the Official Journal in December 2024, entered into force in January 2025, and applies to economic operators from January 2026. It replaces the earlier Regulation 305/2011.

Importantly, the change does not happen overnight. The CE-marking provisions of the old regulation live on in parallel through a long transition of more than a decade, and European assessment documents established under the earlier framework also remain valid for a defined period.

The Declaration of Performance is replaced by the Declaration of Performance and Conformity. The manufacturer therefore declares not only the performance but also that the product conforms to the requirements applying to it.

The Digital Product Passport appears: the product’s data available digitally, in a standard form. In the longer run that also changes how design and installation are documented — collecting paper declarations gives way to a data connection.

The new regulation brings stronger environmental requirements and reporting duties. That improves the availability of life-cycle data for construction products, which is also an input to building-level environmental assessment.

Supervisory powers strengthen and enforcement becomes more uniform.

In the short term, that we will meet two kinds of document: declarations of performance under the old framework and, gradually, declarations under the new one. Both can be valid under their own transitional rules.

What to do:

  • With an incoming document, check which framework it was produced under.
  • On a long project, allow for the form of the documentation changing during construction.
  • The national rules — including the NMÉ system — operate within the EU regulation, so the change feeds through here too.

The summary above reflects the state of the legislation cited as at September 2026. The transitional provisions are complex; for a specific product or procedure the text in force and the position of the designated body govern.
